In 2022, the US Supreme Court held in a 7-2 opinion that group health plans can utilize cost-control designs under the Medicare Secondary Payment Act (MSPA).

This supreme court decision, specifically the statutory and regulatory scheme the Supreme Court was interacting with in this case will be discussed.

Shortly after this ruling, legislation was introduced in both the Senate and House (S.4750 and H.R.8594) in response to the Supreme Court decision. These bills would require plan sponsors to impose limitations and restrictions placed on dialysis coverage to similarly impose these limitations and restrictions on all other chronic diseases covered under the plan. But far from protecting patients, S.4750/H.R. 8594 would eliminate the ability of employer groups to increase price transparency and reduce healthcare costs for high quality dialysis treatments.

Ryan currently serves as the senior vice president of government relations for the Self-Insurance Institute of America, Inc. (SIIA) where he heads up the association’s federal advocacy and political activities before Congress, the Administration, and various federal regulatory agencies. For this work, he has been recognized on Captive Review’s 2015 & 2016 Enterprise Risk Captive Pioneers List.

Prior to joining SIIA, Ryan directed government affairs activities for S&P Global, where he represented brands including Standard & Poor’s, Platts and J.D. Power. Ryan has served in several senior staff positions in the U.S. House of Representatives, most recently as Legislative Director for Rep. Cathy McMorris-Rodgers (WA). He previously served as Chief of Staff to Rep. Katherine Harris (FL) and in various staff roles with the Committee on Ways &Means and the Office of the Speaker of the House.

Christopher J. Walker is a Professor of Law at the University of Michigan. Prior to joining Michigan law faculty in 2022, he spent a decade teaching at The Ohio State University Moritz College of Law. He previously clerked for Justice Anthony Kennedy of the U.S. Supreme Court, worked on the Civil Appellate Staff at the U.S. Department of Justice, and served on the Senate Judiciary Committee staff for the Gorsuch Supreme Court confirmation. 

Professor Walker’s research focuses on administrative law, regulation, and law and policy at the agency level. His publications have appeared in the California Law Review, Duke Law Journal, Georgetown Law Journal, Michigan Law Review, Stanford Law Review, and University of Pennsylvania Law Review, among others. His book Constraining Bureaucracy Beyond Judicial Review is forthcoming with Cambridge University Press. Outside the law school, he chaired the American Bar Association’s Section of Administrative Law and Regulatory Practice in 2020-21 and served as one of forty Public Members of the Administrative Conference of the United States from 2016-2022, and he continues to serve in both organizations in various capacities. He blogs regularly at the Yale Journal on Regulation.

Craig Clemente currently serves as Chief Executive Officer for Specialty Care Management (SCM). With a forte for successfully building strong teams and holding a key role leading all facets of business and strategy, Mr. Clemente has successfully positioned Specialty Care Management as a leading expert in its field with respect to the application of best business and finance practices.

A four-year member of the Self-Insurance Institute of America (“SIIA”) health care committee, Mr. Clemente was the inaugural Chairman of the SIIA Future Leaders Committee for 2018 & 2019, and currently serves on the SIPAC Board for SIIA.
